Edamam LLC’s Edamam.com and Mobile Device Application Privacy Policy
This Privacy Policy describes the information collected by Edamam LLC (“Edamam”, “us”, “we”), how that information may be used, with whom it may be shared, and your choices about such uses and disclosures. By using the website www.Edamam.com (the “Site”) and the services, features, content, applications or widgets, as well as mobile device applications offered by Edamam (collectively with the Site, the “Services”), you are accepting the practices described in this Privacy Policy. This Policy forms an integral part of Edamam’s Terms of Use Agreement, which is incorporated by reference. Any capitalized term used but not defined in this Policy will have the meaning defined in the Terms of Use Agreement.

The Information Edamam May Collect

Information You Provide
Edamam may, in the future, collect and store any personal information you enter through the Services or the Site. This may include personally identifying information, such as your name, residence, e-mail address, credit card information, gender, weight, height, and birthday. Edamam may also request information about your interests and activities, activity level, location, dietary and nutritional habits, and your username. Edamam maintains administrative, technical and physical safeguards intended to protect against the loss, misuse, unauthorized access, alteration, or disclosure of personal information. Nevertheless, no system can be completely secure. Therefore, Edamam does not promise, and you should not expect, that such information may not be inadvertently collected and that such personal information will remain secure.
You also may give us permission to access your information in other services. If you log in to the Services using your Facebook, Google, or other third-party service credentials (each, a “Supported Platform”), you authorize us to collect your authentication information, such as your username, encrypted access credentials, and other information that may be available on or through your Supported Platform account, including but not limited to your name and photos. The information we get from Supported Platforms may depend on your settings or their privacy policies. We may store this information so that it can be used for the purposes explained in this Privacy Policy.
Edamam does not store certain financial data due to its use of third party agents, such as PayPal, Amazon, and Stripe, as its financial transaction facilitators. Please refer to such third parties' Privacy Policies (https://www.paypal.com/webapps/mpp/ua/privacy-full, https://payments.amazon.com/help?nodeId=82974, https://stripe.com/us/privacy/) for more information about how these parties use your information. We do not store any user financial information, even though we may request information about yourself and your credit card and/or bank account. That financial information is handled, processed, and stored by the third party financial transaction processing companies. To the extent that Edamam uses third party providers such as PayPal, Amazon, and Stripe for financial transaction services, we believe that such third parties take the privacy of your personal information seriously and will use your information only in accordance with the terms of their privacy policies.

Information Collected Automatically
Like many sites on the Internet, the Site automatically collects information from your browser when you visit the Site. This information includes your IP address, your browser type and language, access times, the content of any undeleted cookies that your browser previously accepted from Edamam (see "Cookies" below), and the referring website address. If you use Edamam's mobile application, Edamam may collect various non-identifying information, such as your mobile device type, device properties, IP address, profile views, ad views, ad clicks, search queries, photo views, and page views. We may also combine all of this non-identifying information with other non-identifying information to infer interests or demographic characteristics. Because there is not yet a consensus on how companies should respond to web browser-based or other do-not-track ("DNT") mechanisms, we do not respond to web browser-based DNT signals at this time.
In order for Edamam to work with your iPhone, iPod touch, iPad, Windows phone, Android phone, or other mobile device, Edamam must collect your Device Identification Code or "DIC". The DIC is a special type of identifier used in software applications in order to provide a unique reference number for applications like those used by your mobile device. Your DIC is not shared with other users.

Cookies and Use of Cookie Data
Like many sites on the Internet, when you visit the Site, Edamam may assign your computer one or more cookies to facilitate access to the Site and to personalize your online experience. Through the use of a cookie, Edamam also may automatically collect information about your online activity on the Site, such as the web pages you visit, the time and date of your visits, the links you click, and the searches you conduct on the Site. Edamam may use this data to better understand how you interact with the Site, to monitor aggregate usage by our users and web traffic routing on the Site, and to improve the Site and our Services. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies. If you choose to decline cookies, please note that you may not be able use some of the interactive features offered on the Site. In addition, please be aware that other parties may also place their own cookies on or through the Site, and may collect or solicit personal information from you. Other cookies may reflect de-identified demographic or other data linked to the registration data you have submitted to Edamam in hashed, non-human readable form. No personally identifiable information is contained in these cookies.
If you use Edamam's mobile device applications, Edamam may also use mobile cookies. A mobile cookie is a small data file transferred to your mobile device for record-keeping purposes. These mobile cookies help Edamam track session-based information and also better understand the effectiveness of the Services (by way of example only, by keeping track of the location and context in which you view a user profile). These mobile cookies do not contain any personally identifiable information.

Information Collected by Third Parties
Edamam may allow third parties, advertising companies, and ad networks to display advertisements on the Site and via the Services. These companies may use tracking technologies, such as cookies, to collect information about users who view or interact with their advertisements. Edamam does not share information that personally identifies you to these third parties.
If you use the Recipes and Nutrition App on a Samsung Android Device and have chosen to enable Samsung's S Health platform, then you consent to sharing personal health data with the S Health platform. This data is used to provide synchronization between services and may be included in broad health data analysis.

Agents
Edamam employs or engages other companies and individuals (including but not limited to PayPal, Amazon, and Stripe) to perform business functions on behalf of the Site and Services. These persons are provided with personal identifying information required to perform their functions, but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, removing repetitive information from user lists, analyzing data, providing marketing assistance, processing credit card payments and providing user services.
Any supplied billing information (if collected by and through the Site, as opposed to being directly inputted and collected by and through third parties such as PayPal, Amazon, and Stripe) shall be encrypted for transmittal to a third party intermediary for processing. Such billing information is used only to bill you for those products or services you choose to purchase and/or subscribe through the Site and/or Services. The process is designed to protect your billing information against unauthorized misappropriation by third parties. As the technological landscape is constantly changing, no security system is absolutely secure. Edamam cannot and does not guarantee the security of any of its databases and information contained therein, nor can Edamam guarantee any supplied information will be absolutely secure from interception during transmission to the Site and/or Services over the Internet.
How Edamam Uses the Information It Collects
Edamam may use information that it collects as described above to:
- deliver the services that you have requested.
- provide you with customer support.
- enforce or exercise any rights in Edamam’s Terms of Use.
- perform functions as otherwise described to you at the time of collection.
In an effort to provide you with the newest and most useful health and dietary information, we may occasionally send e-mails or newsletter that contain information about products, services, or special offers for Edamam users; some of these correspondences may include advertising materials from third party Edamam affiliates. If you do not wish to receive further correspondence, you may opt out of receiving correspondence from Edamam, by following the instructions to modify your communication preferences in the e-mail or newsletter.
Third-Party Websites
There are a number of places on the Site and the Services where you may click on a link to access other websites that do not operate under this Privacy Policy. For example, if you click on an advertisement or search result, or recipe on the Site or the Services, you may be taken to a website that Edamam does not control. These third party websites may independently solicit and collect information, including personal information, from you. Edamam recommends that you consult the privacy statements of all third party websites you visit by clicking on the "privacy" link typically located at the bottom of the webpage you are visiting.
Children's Privacy
Edamam forbids the use of the Site and Services to individuals under the age of 18. Edamam does not knowingly collect personal information from children under the age of 13.
EU-US Privacy Shield Framework
Edamam complies with the EU-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of Personal Information from European Union member countries. Edamam has certified that it adheres to the Privacy Shield Principles of notice, choice, accountability for onward transfer, security, data integrity and purpose limitation, access, and recourse, enforcement and liability. If there is any conflict between the policies in this Privacy Notice and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Edamam is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).
Some types of personally identifying information may be subject to other privacy-related requirements and policies, which are consistent with the Privacy Shield. For example, personal information regarding and/or received from Edamam’s users is also subject to any specific agreement with, or notice to, said user, as well as additional applicable laws and professional standards.
You may request that we correct, update, or amend the personally identifying information we hold about you. Contact us in the manner described above to update your information. Please know that before we can make any changes to your information, we must confirm and authenticate that you are the data subject making the request for changes. If we deny your request, you will have the opportunity to appeal it, or appeal any other unresolved inquiries, complaints, and disputes.
Visiting the Site and Services From Outside the United States
This Privacy Policy is intended to cover collection of information on the Site and Services from residents of the United States and the Member States of the European Economic Area. If you are visiting the Site or using the Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where Edamam's servers are located and Edamam's central database is operated. By using the Site or Service, you understand that your information may be transferred to Edamam's facilities and those third parties with whom Edamam shares it as described in this Privacy Policy. Changes to the Privacy Policy
Edamam will occasionally update this Privacy Policy. When Edamam posts changes to this Privacy Policy, it will revise the date at the top of this Privacy Policy.
